The meeting among mediators of Vietnam International Commercial Mediation Center and mediators of Singapore

On 09/04/2024, the meeting among mediators of Vietnam International Commercial Mediation Center (VICMC) and mediators of Singapore was held at the Hanoi office of VICMC.

The meeting was honoured to have the attendence of:

  • Ms. Linda Heng – SMC Mediator, SIMI Certified Mediator, IMI Certified Mediator, Co-Founder and CEO of ResoX;
  • LL.M Donna Ross – Mediator, Arbitrator Chartered Institute of Arbitrators (FCIArb), FACICA, FRI;
  • Mr. Michael Lam – SIMI certified mediator, IMI certified mediator, volunteer court mediator, CASE certified mediator;
  • Mr. Stephen Poh – ACIArb mediator, CEDR certified mediator, SIMI certified mediator;
  • Mr. Dixon Soh – Director of RMC, Advocate and Solicitor (Singapore), Barrister and Solicitor (NZ and Aust), IP Mediator.

On VICMC’s side, there were:

  • Assoc. Dr. Nguyen Minh Hang – General Secretary of Vietnam International Commercial Mediation Center (VICMC), Senior Lecturer of Foreign Trade University, CEDR Certified Mediator;
  • Lawyer Nguyen Anh Minh – VICMC’s Mediator, Partner of NHQuang & Associates;
  • Dr. Nguyen Ngoc Ha – VICMC’s Mediator, Deputy Dean of Faculty of Law, Foreign Trade University;
  • Dr. Ha Cong Anh Bao – VICMC’s Mediator, Dean of Faculty of Law, Foreign Trade University.

During the meeting, mediators introduced the process of forming and developing of commercial mediation of the two countries. The foreign mediator shared that for commercial mediation in Singapore to develop as it is today, it requires a lot of efforts from the government, lawyers, and mediation research experts.

From VICMC, Associate Professor, PhD. Nguyen Minh Hang shared that the Vietnamese mediators were also very happy to learn from the experiences of foreign mediators. She shared that Vietnam is currently also promoting the development of alternative methods to resolve disputes outside of court, which including mediation. VICMC as well as other mediation centers in Vietnam have been making efforts to promote mediation to the legal community and business community. Specifically, VICMC has intensify communication on mediation through trainings, organizing seminars on dispute resolution.

However, there are still many obstacles in terms of awareness, mediation market as well as the legal regulations on mediation are only at the Decree level. Therefore, VICMC wishes to receive more in-depth sharing of experience in developing and promoting commercial mediation from Singapore mediators.

The Singapore mediators shared that training for the generation of young students and lawyers is very necessary and useful in building social awareness of commercial mediation – a concept that is still new in Vietnam market. In addition, combining mediation and psychology is also a method worth considering in supporting the mediator’s mediation skills.

Ms. Linda added that online mediation has also been applied by organizations and mediation centers around the world. However, currently, to implement and maintain this platform requires a lot of costs, as well as security and technical concerns…

Acknowledged the shared opinions, VICMC mediators agreed with the development orientation of commercial mediation, which is the need to train students, lawyers and enterprises. In addition, researches is needed to develop and promulgate the Commercial Mediation Law to increase the applicability of the regulations. Joining the Singapore Convention is also a point that needs attention.

Through the meeting, the mediators from both countries have learned more about the mediation culture of Vietnam and Singapore. The Singapore mediators as well as VICMC mediators are ready to support each sides in training and sharing experience to create a foundation for long-term cooperation, aiming to support the business community of the two countries.
