On 28 May 2026, mediators of the Vietnam International Commercial Mediation Center (VICMC) participated in the Seminar titled “DAMAGES AND CONTRACTUAL PENALTIES IN CONSTRUCTION DISPUTES: LEGAL AND PRACTICAL PERSPECTIVES”, organised by the Society of Construction Law Vietnam (SCLVN), with the support of the Vietnam International Arbitration Centre (VIAC).
The VICMC mediators attending the Seminar included:

At the Seminar, Assoc. Prof. Dr. Nguyen Minh Hang delivered a presentation on: “Experiences/Perspectives from France and China on Liquidated Damages in Construction Contracts”, providing valuable comparative analyses drawn from international practices regarding the recognition and application of liquidated damages mechanisms in construction contracts.
In addition, Mr. Luong Van Ly presented a paper entitled: “Recommendations on the Application of ‘Liquidated Damages’ in Vietnam”, focusing on challenges arising from current legal practices and proposing recommendations to improve dispute resolution mechanisms in the construction sector.
The discussion session among speakers and participants was dynamic and insightful, clarifying a number of unresolved issues in both the understanding and application of laws relating to damages and contractual penalties in construction disputes. The discussions contributed to supporting the drafting, performance, and dispute resolution of construction contracts in Vietnam in a more transparent, efficient, and internationally aligned manner.
The Seminar served as an important professional forum connecting academic and practical perspectives, while promoting multidimensional dialogue on legal issues currently attracting significant attention in the construction industry.
