On On April 5, 2025, in Ha Long city, Quang Ninh province, the International Conference on Perfecting the institutions to realize the principle “Harmonized benefits, shared risks” in direct investment field was held and attracting the participation of experts, scientists, state management agencies, international organizations, domestic and foreign investors and enterprises.
At the conference, mediators of VICMC presented and shared opinions and contributions to realize the principle of “Harmonized benefits, shared risks”.
Lawyer.Mediator. Nguyen Hung Quang – President of VICMC, Managing Partner of NHQuang&Associates presented topic: Commercial mediation in investment activities – Current situation and recommendations to ensure the implementation of the principle “Harmonized benefits, shared risks”. In his speech, Mr. Quang said that mediation is necessary in resolving investment disputes, which including minimizing the risk of disputes between the state and investors; enhancing the reputation of the investment market to attract, maintain and expand investment of investors. In addition, Mr. Quang also recommended that the investment dispute prevention mechanism according to the experience of World Bank is suitable for the negotiation and mediation methods in Vietnam. At the end of the presentation, Mr. Quang suggested that Vietnam should build a mechanism to handle obstacles in investment activities; build a coordination mechanism between agencies and early warning mechanism; a mechanism to resolve obstacles to prevent and mediate investment disputes in accordance with the orientation of “Harmonized benefits, shared risks”.

In addition, at the conference, Lawyer.Mediator. Nguyen Tuan Phat – Head of the energy and infrastructure working group of VICMC; Director of legal, compliance and government relations of Asia Clean Capital Vietnam Company shared a presentation: Sharing risks and harmonizing benefits in investment activities from the perspective of investors in the field of renewable energy: International experience and lessons for Vietnam. In his presentation, Mr. Phat also strongly encouraged the use of mediation to resolve renewable energy disputes.

The conference also received the participation and contributions of Mediator. Nguyen Nam Trung – Mediator of VICMC; Chairman of Vietnam Construction Law Association (SCLVN).

With more than 30 presentations from experts, the conference was successfully organized, providing contributions to help perfect the legal system, ensuring transparency, fairness and efficiency in investment management.
