SUMMARY OF THE SEMINAR ON MEDIATION IN COUNTRIES AROUND THE WORLD AND THE ROLE OF LAWYERS ON 4/7/2025

On July 4, 2025, the Faculty of Law, Foreign Trade University; with the participation of the Vietnam International Commercial Mediation Center (VICMC), Association Pour La Coopération Juridique Europe Vietnam (ACJEV) and the International Mediation Council (CIM), the Société de Législation Comparée (SLC), the Vietnam Committee of the Paris Bar Association organized a seminar on “Mediation in countries around the world and the role of lawyers”.

The  seminar is an event that helps experts, mediators, lawyers, lecturers and students have the opportunity to exchange and discuss mediation in different countries as well as the use of mediation to resolve disputes in different fields.

The seminar is honoured to welcome Mr. Romain Busuttil – Deputy Counselor for Cooperation and Cultural Activities, French Embassy in Hanoi and Ms. Priscille de CAMBOURG – Officer in charge of Legal Cooperation, French Embassy in Hanoi, who represented the Embassy to congratulate the connection between Vietnamese lawyers and the French Bar Association.

On the side of the organizing unit, there were representatives of Foreign Trade University: Dr. Ha Cong Anh Bao – Head of the Faculty of Law, Foreign Trade University, Mediator of VICMC; Associate Professor. Dr. Nguyen Ngoc Ha – Director of the Institute of Creative Research, Foreign Trade University, Mediator of VICMC.

On the side of the participating units, there were representatives of VICMC: Lawyer Nguyen Hung Quang – President of VICMC; Head of NHQuang&Associates Law Office; Associate Professor. Dr. Nguyen Minh Hang – General Secretary of VICMC – Head of the Department of International Business Law, Faculty of Law, Foreign Trade University.

On the side of the experts from France and Italy, there was the participation of Mrs. Thi My Hanh NGO-FOLLIOT – Lawyer of the Paris Bar Association, President of the European – Vietnam Legal Cooperation Association, President of the Vietnam Committee – Paris Bar Association, President of the Vietnam Committee – Comparative Law Association, Vice President of the International Committee on Mediation; Mrs. Christiane FERAL – SCHUHL – Vice President of the French National Mediation Council; Mr. Alberto TARAMASSO – Lawyer of the Paris and Genes Bar Association; Mr. Vincent BERTHAT – Lawyer; Mrs. Iren BEKRIEVA – Mediator; Mr. Dimitar BEKRIEV – Mediator.

In addition, the seminar also welcomed Mr. Phan Trong Dat – Acting Director of the Vietnam Mediation Center (VMC); Associate Professor, Dr. Chu Hong Thanh, Former Director of the Legal Department – Ministry of Education and Training – Mediator of VMC; Lawyer Duong Quoc Thanh – Founder and Executive Lawyer of ALV Lawyers – Member of the Executive Board of Vietnam International Commercial Lawyers Club; Dr. Nguyen Thi Tinh, Dean of Law Faculty, University of Commerce, Dr. Nguyen Thi Minh Hue – Director of the Center for International Integration Lawyer Training – VICMC Mediator.

In his welcome speech, Lawyer Nguyen Hung Quang expressed VICMC’s pleasure to participate in the seminar on the topic of the role of lawyers in mediation. With the desire to study and learn experience of commercial mediation from the mediators from other countries in the world, VICMC hopes to continue to participate in a series of similar professional seminar.

At the first session of the event, the experts from France and Italy gave an overview of the ethical standards and skills required to become a mediator as well as how to manage mediators, measures to promote mediation in France and other countries in the European region (such as the law requiring mediation for disputes in the fields of family, labor or disputes with a value of less than 5,000 Euros). In addition, the topic of using AI in mediation was also shared by experts and received attention due to its topicality and opinions revolving around the advantages and disadvantages of AI.

At the second session, Lawyer Nguyen Hung Quang gave an in-depth presentation on “Identifying cultural dimensions in negotiation and mediation”. Lawyer Quang used the method of analyzing the culture of countries and ethnic groups through different dimensions (culture dimensions) to help lawyers and mediators build their own negotiation and mediation strategies.

The seminar also received enthusiastic discussions from lecturers on the experience of adding mediation as a subject in law training institutions or the experience of the statute of limitations for lawsuits when applying mediation in French law, which is that the statute of limitations for lawsuits is calculated only when the mediation period has expired.

The seminar ended successfully with sharings and lessons learned from experts from countries around the world. In the future, the regulations on dispute resolution in general and dispute resolution by mediation will be further improved, becoming a trend in Vietnam.
